These Terms of Service (the "Terms") set out the conditions for using IchizaCall (the "Service"), a scheduling tool provided by IchizaCall Operations Office (the "Operator"). By using the Service, you agree to these Terms. This English version is a translation; if it differs from the Japanese version, the Japanese version prevails.
1. Definitions
- "Organizer" means a person who creates a project on the Service and collects availability.
- "Respondent" means a person who receives an invite link from an Organizer and answers with their availability.
- "User" means anyone who uses the Service, including Organizers and Respondents.
- "Project" means the unit an Organizer creates to collect availability.
- "Plus" means the paid plan of the Service.
2. The Service
- The Service helps Organizers collect Respondents' availability and choose a date.
- By default, only the Organizer can see Respondents' answers. If the Organizer changes visibility to "Everyone," Respondents can also see each other's answers.
- No password is required. Organizers can sign in with a link sent to their email address to see their projects and manage Plus.
- Anyone who has the link to an organizer page or an answer page can open that page. Please keep these links safe.
3. Nature of answers
- An answer (Available, Maybe, Unavailable, and any notes) shows the Respondent's expected availability at the time of answering. It is not a booking, an order, or an offer or acceptance of any contract.
- Any request, contract, fee or schedule change between an Organizer and a Respondent is agreed between them. The Operator is not involved in, and is not responsible for, those arrangements.
4. Emails sent by Organizers
- Organizers can notify Respondents of the final date and similar information by email through the Service.
- Organizers write the text of these emails and are responsible for their content.
- Emails are sent only to the address each Respondent entered when answering. They may not be used for advertising, solicitation, or anything unrelated to scheduling.
5. Prohibited conduct
Users must not:
- Break any law or act against public order or morals
- Answer as someone else, or change someone else's answers without permission
- Use the Service for spam, solicitation or advertising
- Enter or publish another person's personal information without their consent
- Place excessive load on, or gain unauthorized access to, the Service's servers
- Use someone else's email address to get around free-plan limits
- Do anything else the Operator reasonably considers inappropriate
If the Operator decides that a User has done any of the above, it may delete the related projects or answers, or suspend use of the Service, without prior notice.
6. Free plan and advertising
- On the free plan, each Organizer email address can run one active project at a time (a project whose date hasn't been set and whose date range hasn't ended).
- On free-plan projects, ads are shown on the screen Respondents see after answering.
7. Plus
- Plus costs $3 per month, or $30 per year. Taxes may be added depending on your location.
- The first 100 members, as determined by the Operator, can use Plus for $2 per month. This price applies for as long as the subscription continues. If a member cancels and later subscribes again, the regular price at that time applies.
- Payment is made by credit card or other methods through the payment service designated by the Operator (Stripe).
- Plus renews automatically at the end of each period (one month or one year) unless canceled, and the fee is charged at each renewal.
- You can cancel at any time from within the Service. After canceling, you can keep using Plus until the end of the period you have already paid for.
- Fees already paid are not refundable, including for partial periods. This does not apply if you could not use the Service because of the Operator's fault.
- If the Operator changes the price, it will announce the change on the Service at least 30 days in advance. The new price applies from the first renewal on or after the date of the change.
8. Deletion of data
- Projects and their answers are deleted automatically 90 days after the scheduling period ends. Deleted data cannot be recovered.
- Please keep a copy of any information you need.
9. Changes to and suspension of the Service
- The Operator may change the Service or suspend it temporarily.
- If the Operator ends the Service, it will announce this on the Service at least 30 days in advance. In that case, any unused part of an annual subscription will be refunded.
10. Disclaimer
- The Operator does not guarantee that the Service will meet your purpose or be free of defects.
- The Operator is not liable for damage arising from use of the Service, except in cases of the Operator's intent or gross negligence.
- Where the Operator is liable, its liability is limited to the fees the User paid in the month the damage occurred. This limit does not apply where the User is a consumer and the damage was caused by the Operator's intent or gross negligence.
11. Changes to these Terms
The Operator may change these Terms when necessary. It will announce the new Terms and the date they take effect on the Service in advance.
12. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute relating to the Service. This does not limit any mandatory consumer protection rights you have under the laws of your country of residence.
